Well we are way way OT now, my point is simply that Japanese entertainment productions (including JAV) are mostly funded upfront and there's minimal practice of royalty to complement salary. Most often the person most in debt is the performer him/herself. As some of them owe money to the studio/agency for cosmetics, training classes, studio fees etc.

I know you are just being fastidious and not seriously in a debate mood. So I will let you off ;)

In Japan the Porn actress does many events were they get paid for each event.
The more popular they are the more they are call to do photo shootings, fan sign events or even go to some events around Asia.

Also remember R18 owns quite a few top studios. Yet they say they would love to offer drm-free but the studios wont allow them to sell it that way. Quite the corporate double speak. Since the top studios set the trend and are the exact same people.

Also it's a complete lie since other studios do allow drm-free on duga.jp while r18 forces it on every release.

Also remember you dont own any content even after paying 30 bucks for a title. Many actressses are pulling titles now after 5 years.

I have spent 200 dollars on HD copies of Risa Shiina's videos that are now gone from my drm-locked library forever. Essentially stolen from me. And no I didnt buy the stream option. I bout the HD download option. That is no gone forever. And r18 is extremely rude in chat and tell me to go to the manufacture to complain.

I will say r18 is right up there with comcast as the worst company I have ever dealt with. And that is saying something. I rarely complain or a bothersome customer.

When happens at least offer a coupon or rebate or something. I didnt even want a full refund. But just got completely shit on by the support people. I will now spen all my energy telling everyone I know to stay away because of your horrible customer service an attitude. Blaming literally everything on the customer or someone else.

I just want to clarify some of your points.
DMM does not own any studio anymore. The company sold its group company WILL (The ones that own the adult studios S1, MOODYZ, IDEA POCKET etc) more than 2 years ago.

Pulling out tittles from out site is by the studios request what is in most of the cases a legal requirement.
We usually are welcome to do refunds when the purchase date and the time were the product has been pulled out is in a short time.

I'm no big fan of DMM/R18 myself, but I would say a few things to their defense. (if I'm correct)

So DMM is under "legal" obligation to stop serving the video after an ex-actress withdraw her vids. It seems counter to common sense if "HD Download" "product" are also affected, assuming all the video data is already on your own storage. If I guess correctly the player is accessing DMM server to authenticate your ownership of the video before letting you play the vid that (you think) you own. Somehow, some legal "genius" must have decided the authentication of ownership is equivalent to circulation so is covered under withdrawal.

So your problem doesn't come out of commercial greed (as with Comcast) but out of a conflict between JAV actress's "legal" right and end-user's "ownership", and DMM is just in between doing what they are supposed to do, legally. Even in the imaginary world that each side come with good lawyers and legal resource, I imagine it will end up a hot pile of legal mess.

Ultimately it comes to WHY you or anyone wants to buy legit JAV. (1) can't access piracy, (2) wish to comply with the law, (3) wants to support actress and content producers. If you are (3) than the best practice is to pay for some "products" from DMM/R18 and get your vids from piracy. If you are (2) then either you should accept whatever the law says or file a lawsuit. Most people are NOT absolute about complying with the laws, obviously. According to strict laws, buying or selling a used book is illegal. (I only assume it extends to DVD) Yet a lot of people buy legit movies on physical media to watch and then re-sell it 6 months or 10 years later. So they comply with copyright laws upfront and then violate it in the backend.

I think most people would feel morally they should pay for JAV but not necessarily comply with all the related laws, especially when an ex-actress can stop you from watching her porn after 5 years.

It was just a few weeks ago when R18.com released the future to download movies on your iOS devices and this week is the time for VR movies also.

We will keep going and give support to more devices in the near future.

My "first-hand" information was also that JAV actresses are paid for every event or shooting, the amount depending on their popularity and also depending on the demand for the shooting (whips and pain pays a little better then just petting and sweettalk >v< ).

I am assuming you are strictly talking about Japan? Cause that isn't close to true in the US or many parts of the world.

About second hand books, I was absolutely talking about US and many countries that follow US lead. Of course no publisher actually dare to test the current practice which is second hand book trade (and CD/DVD etc) is tolerated and not very underground. Even Amazon hosts huge number of "independent" book sellers who buy and sell second hand books which in violation of the letters of the law.

Ahh... and there's even the public libraries. Mostly run by various governments (typically city and county govs) or by schools, universities etc. They also operate in some legal gray areas. I have heard many industry insiders gnash their teeth at what they think as copyright trampling by many libraries.

Ahhh... but the Trump factor... There's a chance the publishing industry can bring a mega test case with a Trump-infused court and nuke the whole library business.

Well if you insist on digging into the weeds. True that there's a First sale doctrine which is at work. But a legal doctrine is not law, that was my original argument. "First sale" is protected only by practice not by code of law.

On the plus side "First sale" has been established for a long time so it may seem unshakable, on the minus side, a legal doctrine is always more shaky than a law (in US case) passed by congress, senate and signed by a president. So First sale doctrine is more shaky than Obamacare, that can only be repealed by congress+senate+president. A single judge is all it takes, if industry can very cleverly construct a test case, weaken it or even upend First sale.

At least it seems more solid than Net neutrality and DACA (illegal children), those two are gone.

It doesn't and you are still wrong. Copyright Act of 1976, 17 U.S.C. § 109 makes clear that First-sale doctrine is law.

Upgrade previous purchases from SD to HD without having to buy again.
