Source, please.

Article 34 of the Child Welfare Law
" Any person shall not do any of the following acts : …(6) act of inducing a minor to be engaged in
sexual activities … "
Inducing a minor who is less than eighteen (18) to be engaged in sexual activities is subject to
punishment under the Child Welfare Law. According to Japanese Court cases, " inducing a minor to
be engaged in sexual activities means an act of working on a minor to have intercourse or analogous
conducts ( including oral and anal sex) with him or her, or with someone else by exerting influence on
the minor virtually.

This case concerns a consensual act whereas "induce" in this case would be to use ones influence as a guardian or other authoratative position for personal sexual gratification involving a minor, (probably illegal to do to adults as well).

Also remember that local laws can influence the severity of the charges and sentencing.

illegal sex is not considered r***

Semantics.

Actually r*** is illegal sex.

r*** by definition is an act of sex forced on another without their consent. So having sex with another person who is under the age of consent is considered r***. Although this is widely referred to as statuatory r*** that does not matter. You can argue the age of consent all you wish but you cannot change the definition of a word because of where the word comes from. If a person is unable to consent to having sex then having sex with that person would be r***.

In any allegation of r***, the absence of consent to sexual intercourse on the part of the victim is critical

Actually I think you have it backwards. Nationally, the age of consent is set at 18, but certain prefectures or local governments set age of consent lower in accordance with local practices. Cases of legal sexual activity among "minors" is far and few between, with most prosecutors citing the aforementioned Child Welfare Law in order to gain a conviction.

Generally speaking, any sexual activity with a minor under the age of 16 is considered statuatory r***. Between 16 and 18 exists a grey area, depending on the consent of the guardian (but this is more generally applied to the fact that you can legally get married once you turn 16, as long as your parents consent). After 18 is, of course, fair play.

Really, age of consent laws in Japan are not all that different from other countries (thanks to massive pressure from America and other western countries to modify their legal code to match western "standards"). The only thing that should ever surprise anyone about Japan is the relatively relaxed sentencing (usually a slap on the wrist for a first offense, and no more than 12-18 months even with a guilty plea, often reduced if you accept rehabilitation). Of course, I say relatively, because other countries (particularly America) seem hellbent on maximizing and extending sentencing.

Other age limits:

Drinking, smoking, voting, and gambling are legal from the age of 20. [Drinking at the age of 20 is no more "underage" than smoking at 20 is "overage".]

Perhaps morally questionable, appearing in AV is legal from 18, despite such models being unable to drink or smoke.

And generally speaking, as long as you hold a valid drivers' license, you are able to rent a car with no hard age restriction, unlike in some countries such as America which limit it to 25+.

I really think you should double check your sources guy. To reiterate:
http://en.wikipedia.org/wiki/Ages_of_consent_in_Asia
http://www.ageofconsent.com/japan.htm

The national age of consent in Japan is 13 as specified by the Japanese Penal Code Articles 176 and 177. However, prefectures can have ordinances that prohibit sexual activities with any minor under 18.

‘r***’, Art. 177 Penal Code 'A person who, through violence or intimidation, has sexual intercourse with a female person of not less than thirteen (13) years of age commits the crime of r*** and shall be punished with imprisonment at forced labour for a limited term of not less than two years. The same shall apply to a person who has sexual intercourse with a female person under thirteen (13) years of age.

'Indecency through compulsion', Art. 176 Penal Code 'A person who, through violence or intimidation, commits an indecent act upon a male or female person of not less than thirteen (13) years of age shall be punished with imprisonment at forced labour for not less than six months nor more than seven years. The same shall apply to a person who commits an indecent act upon a male or female person under thirteen (13) years of age.

Thus, under National law, statutory r*** would be having sexual relations with females under 13 years of age. (The laws for males may be slightly different)

In addition sex is only mentioned once in the "Child Welfare Act" and that is concerning the employment of girls under the age of 15.

I truly hope Takamina could survive this ! :please:

This case reminds me off the rumor around Rina Nakanishi's mother, in which she is a gambling addict or some kind of trouble maker, and now, look at what happened to Rinatin's career. :scared:

I hope Takamina is strong enough, she's one of my favorit AKB48 member.:cheer:
