This is me just being paranoid, but has anyone ever gotten caught (i.e. legal action) while downloading torrents from Akiba? I'm guessing the government doesn't monitor JAV torrent content as much, but a part of me does wonder. Though I am not sure how much power they would have in the matter.

Actual legal action against those sharing via bittorrent isn't unheard of yet considering the amount of bittorrent traffic the odds overall are pretty small. Also there is some concerns as to if pornography is even covered under the copyright act in the USA (not sure about elsewhere). There are "copyright trolls" who are a nuisance in certain parts of the world but I do not know anyone who actually got sued by them. As far as Akiba-Online goes I personally know of no instance where legal action has ever occured.

The fact is, someone payed for the material in the first place. The debate over whether a person should have a right to share what they payed for is an ongoing argument. Imagine, if you will, that someone said you could not give your car to someone else or even let them use it, or that sharing your lunch with someone was now illegal? Extreme examples? Yes, they were, but they are also very applicable. I suggest you read some of what Rick Falkvinge has to say on the subject. Mind you, I have a lot of personal differences with his political views but on copyright issues I pretty much agree with him down the line. Check out torrentfreak too, it is a great filesharing news source.
