Winny software developer aquitted.
Oct 11, 2009 - 12:25 AM - by isityours
Former Tokyo University associate researcher and developer of the Winny file-sharing software, Isamu Kanako, 39, was aquitted on infringment of Copyright Law charges by the Osaka High Court on Thursday last week.

In the Kyoto District Court ruling in December 2006, Kaneko was accused of encouraging users to violate Coptright Law by distributing his peer-to-peer file-sharing software and ordered to pay a 1.5 million yen fine. High Court Judge Masazo Ogura overturned this decision saying "The defendant did not clearly intend to violate the Copyright Law, therefore cannot be charged with abetment.

According to the first ruling, Kaneko put the latest version of the Winny file-sharing system online in September 2003, knowing it would facilitate copyright infringement. The ruling also said he helped two men from Matsuyama and Takasaki, Gunma Prefecture, respectively, distribute 28 copyrighted games and movies using the software in the same month. The two men were convicted of violating the Copyright Law.

Yoshiaki Tsuchitani, a lawyer of the Osaka Bar Association who is familiar with copyright issues in the United States, said such rulings are rare in Europe and the United States, adding, "It would discourage software developers who might fear being charged."

Japan plans to make the downloading of illegally copied music an offence but the full details have not yet been released.

Japan's ISPs have been in official cooperation with copyright owners since last year.....http://blogs.zdnet.com/Ou/?p=1063.

I wonder how this kind of action will affect those of us living in Japan as stories of disconnection all over the world seem to be growing of late.

JR installs anti-suicide lighting on platforms
Sep 21, 2009 - 5:59 PM - by Darth Demon
Source: Japantoday.com Article

"TOKYO — East Japan Railway (JR East) is installing blue mood-lighting in its stations in a bid to stop people committing suicide on the tracks of a busy Tokyo line. The blue LED ceiling lamps have already been fitted at seven stations of the Yamanote line, which is used by millions a day, and will be fixed at all 29 stops by late October, a JR East spokesman said.

“Blue is said to make people’s minds more serene. The blue lighting is in part an effort to prevent suicides, while it is also aimed at reducing misdemeanors such as graffiti and littering,” he said.

In the first half of the year, police recorded 17,076 suicides, up 768 or 4.7% from the same period last year, according to the National Police Agency, which said one third of suicides were linked to financial problems. Sixty-eight people committed suicide at stations operated by JR East in the year to March, up from 58 the year before and 42 in 2006."

Train-grope website pervs under pressure
Sep 18, 2009 - 10:04 PM - by Leechasd
By Lester Haines

Japanese police are planning to "put pressure" on websites which offer pervs top tips on how to grope women on trains without getting cuffed, and the best packed commuter lines on which to fondle victims.

Earlier this year, a 23-year-old man who was arrested in Tokyo for molesting a high-school student told police he'd "chosen the Siakyo Line to carry out his attack because it had received high marks on a bulletin board dedicated to gropers".

The Yomiuri newspaper said the man explained to officers that he had "used the website to work on the most effective methods of molesting women and 'wanted to confirm' if they were effective".

Accordingly, the Telegraph reports, the powers that be are eyeing 100 such websites which have contributed to the growing problem of groping. While around 1,800 arrests are made each year, police reckon the actual number of incidents is much higher, since victims are "too embarrassed" to come forward.

The National Police Agency further announced it will liaise with train operators to consider other groper-busting measures, possibly including security cameras inside carriages, security guards and "more women-only carriages for the busiest times of the day".

Ultimately, the Telegraph notes, it's often difficult to secure a conviction for groping since the allegations are hard to prove.

The Supreme Court last year acquitted a 63-year-old professor at the National Defence Medical College of molesting a teenage girl on a train in 2006. He'd previously been sentenced to 22 months in prison by a lower court, "based solely on the testimony of the alleged victim".

-While the younger/older men are attacking Japanese women somewhat finest meats, the old group grannies in turn are pinching young men on the buttocks for possible revenge?

Opposition wins landslide in Japan election
Aug 31, 2009 - 5:46 AM - by elgringo14
I think this is of interest, especially with the recent debates about adult games/mangas/videos regulation/banning/whatsoever.

---------------------------------------------------------------------

TOKYO -- Japan's opposition party won historic elections in an apparent landslide Sunday, media projections said, sending the conservatives to defeat after 54 years of nearly unbroken rule amid widespread economic anxiety and desire for change.

The left-of-center Democratic Party of Japan was set to win 300 or more of the 480 seats in the lower house of parliament, ousting the Liberal Democrats, who have governed Japan for all but 11 months since 1955, according to exit polls by all major Japanese TV networks.

The loss by the Liberal Democrats would open the way for the Democratic Party, headed by Yukio Hatoyama, to replace Prime Minister Taro Aso and establish a new Cabinet, possibly within the next few weeks.

The vote was seen as a barometer of frustrations over Japan's worst economic slump since World War II and a loss of confidence in the ruling Liberal Democrats' ability to tackle tough problems such as the rising national debt and rapidly aging population.

The Democrats have said they will seek a more independent relationship with Washington. But Hatoyama, who holds a doctorate in engineering from Stanford University, insists he will not seek dramatic change in Japan's foreign policy, saying the U.S.-Japan alliance would "continue to be the cornerstone of Japanese diplomatic policy."

National broadcaster NHK, using projections based on exit polls of roughly 400,000 voters, said the Democratic Party was set to win 300 seats and the Liberal Democrats only about 100. Official results were expected early Monday.

TV Asahi, another major network, said the Democratic Party would win 315 seats.

The LDP's secretary-general, Hiroyuki Hosoda, said he and two other top officials plan to submit their resignations to Aos, who serves as president of the party.

As voting closed Sunday night, officials said turnout was high, despite an approaching typhoon, indicating the intense level of public interest in the hotly contested campaigns.

"We've worked so hard to achieve a leadership change and that has now become almost certain thanks to the support of many voters," said Yoshihiko Noda, a senior member of the DPJ. "We feel a strong sense of responsibility to achieve each of our campaign promises."

Ruling party leaders said they were devastated by the results.

"I feel deeply the impact of this vote," former Prime Minister Shintaro Abe, a leading Liberal Democratic Party member, told television network TBS. "Our party must work to return to power."

Even before the vote was over, the Democrats pounded the ruling party for driving the country into a ditch.

Japan's unemployment has spiked to record 5.7 percent while deflation has intensified and families have cut spending because they are insecure about the future.

Making the situation more dire is Japan's aging demographic - which means more people are on pensions and there is a shrinking pool of taxpayers to support them and other government programs.

"The ruling party has betrayed the people over the past four years, driving the economy to the edge of a cliff, building up more than 6 trillion yen ($64.1 billion) in public debt, wasting money, ruining our social security net and widening the gap between the rich and poor," the Democratic Party said in a statement as voting began Sunday.

"We will change Japan," it said.

Hatoyama's party held 112 seats before parliament was dissolved in July.

The Democratic Party would only need to win a simple majority of 241 seats in the lower house to assure that it can name the next prime minister. The 300-plus level would allow it and its two smaller allies the two-thirds majority they need in the lower house to pass bills.

Many voters said that although the Democrats are largely untested in power and doubts remain about whether they will be able to deliver on their promises, the country needs a change.

"We don't know if the Democrats can really make a difference, but we want to give them a chance," Junko Shinoda, 59, a government employee, said after voting at a crowded polling center in downtown Tokyo.

Having the Democrats in power would smooth policy debates in parliament, which has been deadlocked since the Democrats and their allies took over the less powerful upper house in 2007.

With only two weeks of official campaigning that focused mainly on broadstroke appeals rather than specific policies, many analysts said the elections were not so much about issues as voters' general desire for something new after more than a half century under the Liberal Democrats.

The Democrats are proposing toll-free highways, free high schools, income support for farmers, monthly allowances for job seekers in training, a higher minimum wage and tax cuts. The estimated bill comes to 16.8 trillion yen ($179 billion) if fully implemented starting in fiscal year 2013.

Aso - whose own support ratings have sagged to a dismal 20 percent - repeatedly stressed his party led Japan's rise from the ashes of World War II into one of the world's biggest economic powers and are best equipped to get it out of its current morass.

But the current state of the economy has been a major liability for his party.

"It's revolutionary," said Tomoaki Iwai, a political science professor at Tokyo's Nihon University. "It's the first real change of government" Japan has had in six decades.

AP reporters Mari Yamaguchi, Kelly Olsen, Shino Yuasa and Tomoko Hosaka contributed to this report.

J-pop commercial complex opens in San Francisco
Aug 16, 2009 - 5:55 PM - by Darth Demon
Source: Japantoday.com Article

"SAN FRANCISCO — New People, possibly the first commercial complex dedicated to J-pop in the United States, opened Saturday in Japan Town, San Francisco, drawing a long line of young people crazy about Japanese music, fashion and animation. A three-story, glassed-in facility houses a store selling books, toys, DVDs and other merchandise related to Japanese pop culture, clothing stores including the first U.S. flagship store of Baby, the Stars Shine Bright, or ultimate ‘‘Lolita’’ fashion brand as it is known among J-pop fans, a movie theater and an art gallery.

Jennifer Filo, 22, and Saru Bell, 18, said they started to line up at 4 a.m. Saturday to enter the building ahead of its grand opening at 11 a.m. Clad in black Gothic and Lolita fashion, the two said they had been looking forward to the opening of New People, taking pictures together every Friday since spring in front of the facility while it was under construction.

The day’s opening featured commemorative event J-pop Summit, showcasing Tokyo’s latest Gothic and Lolita wear at an outdoor fashion show, drawing more than 1,000 spectators including ‘‘Cosplayers,’’ or those wearing costumes of Japanese cartoon characters.

Seiji Horibuchi, president of VIZ Pictures Inc, who is among the key individuals who worked to realize the New People project, said during the event, ‘‘Let’s make the 15th of August a J-pop Day around the world,’’ and was cheered by the spectators.

Horibuchi has been involved with the distribution of Japanese films and DVDs as well as the English translated versions of Japanese comics in North America."
